We are legally required to obtain Right to Work (RTW) evidence as part of the Transfer of Undertakings (Protection of Employment) (TUPE) process and employers who acquire staff as a result of a TUPE or Cabinet Office Statement of Practice (COSOP) transfer cannot rely on another employer’s right to work checks and therefore need to undertake checks with their new employer.
In order to undertake this process, we are working with our colleagues at the NHS Business Services Authority (NHSBSA) HR Shared Services (HRSS) Department, who will initiate this check using their digital pre-employment checking system, Amiqus.
Amiqus is a secure platform and exceeds the requirements outlined by the GDPR and the UK-GDPR. Files are also permanently deleted from the Amiqus server following a 12-month period in line with NHSBSA retention periods.
How do I access Amiqus?
You will receive an email containing a link to Amiqus to allow you to complete your RTW check. Please can we also request that you check your junk folders for the email if you do not receive it into your inbox.
When you access the system you will be asked to provide a true likeness of yourself (this is typically a passport or photocard driving licence) to verify your identity, you will then go on to upload your right to work evidence. The system will guide you through each step of the process.
How long do I have to complete my RTW check?
You will have 10 days in the first instance to complete the check and the NHSBSA can extend this up to a maximum of 20 days to ensure colleagues have an adequate opportunity to engage before our grace period expires.
What if I cannot provide photographic evidence to verify my identity?
If you do not have photographic evidence to verify your identity you will be unable to submit your documents digitally using the Amiqus system, in this instance please contact ContactHRandOD@england.nhs.uk.
